Navigating the Employment Tribunal: Part 2

From the Perspective of a Claimant who ‘lived to tell the tale’.

Though racism against ‘othered’ teachers (Black, Asian, white with a foreign accent) is rarely covered by the media, this ‘disease’ has, for years, been a pandemic in the Education sector. This is a very ironic situation since educational establishments should be places where ignorance is tackled and not fed! 

A report of the Commission for Black Staff in Further Education published in 2002, highlights the typical anxieties experienced by black FE teachers:

  • Subtle stereotyping of black teachers, which traps them in jobs with little hope of progression, and sometimes leading to overt bullying and harassment.
  • Negative views about the competence of black staff, sometimes leading to an over-critical or over-controlling management style.
  • Student complaints instigated by managers or colleagues.
  • Complaints of racism leading to victimisation, marginalisation, and recommendations for unjustified performance reviews.

The Respondent’s witness statements, when read without the contextualising evidence I was able to produce in order to shift the burden of proof, are very convincing – very believable. My advice therefore to anyone thinking of taking their employer to the ET is, make sure you have evidence for every single allegation you make against your employer.
